GENERAL BOOKING CONDITIONS

When booking via VN Consulting, the CUSTOMER expressly accepts each of the general conditions considered as an integral part of the booking and supplemented by the applicable specific legislation. These conditions are a translation of the text in Spanish offered for informational purposes only. In case of doubt in the interpretation of these conditions, will prevail the text in Spanish, which you can find here

1.    CONDITIONS OF RESERVATION

The accommodations can be booked online by the CUSTOMER or by calling the number indicated on the website. For online reservations, an availability request (pre-booking) will be sent first , and confirmed by VN Consulting to the CUSTOMER within a maximum of 24 hours.

In the email confirmation of availability, a link will be sent to the CUSTOMER to make the payment corresponding to 30% of the total amount of the reservation, excluding services, additional costs, deposit and tourist tax (if any), this can be paid by credit card or bank transfer. When paying the reservation, the CUSTOMER declares at the same time that he has read and understood the terms and conditions of VN Consulting and that he accepts them.

The CUSTOMER will receive an email confirming the booking for his vacation once the payment of the booking amount has been made. This email must be shown on arrival to VN Consulting personnel responsible for key collection.

2.    PRICE AND PAYMENT POLICY

2.1. Prices

The published PRICES of the accommodations are always PRICES per NIGHT and ACCOMMODATION based on the period indicated and are expressed in EUROS.

VN Consulting carefully prepares both the descriptions of the ACCOMODATION and the published PRICES, so that they reflect reality at all times. However, these may in some cases undergo changes that will be communicated at the time of booking.

2.2. Payments

The payment transaction will be made in EUROS, regardless of the origin of the CUSTOMER or the ACCOMODATION selected.

The payment of 30% of the total amount of the booking, excluding services and additional charges, will be made by bank transfer or credit card.

The remaining amount (70%) plus services, additional charges, security deposits and tourist tax (if any) must be paid on arrival upon key collection.

 

3.    RESERVATION CANCELLATION POLICY

VN Consulting reserves the right to cancel the reservation if, after 3 working days from the confirmation of the availability of the reservation the payment of 30% of the total amount of the reservation, without including the services and additional charges, has not been done.

VN Consulting reserves the right to cancel the booking if the CUSTOMER does not show up at the ACCOMMODATION the day of his arrival. In this case, the CUSTOMER will not be able to claim or demand the refund of the amounts already paid.

In case of force majeure or inability to accommodate the CUSTOMER in the ACCOMODATION, VN Consulting will offer the possibility to choose (as far as possible) the replacement of the ACCOMODATION with another of similar characteristics, or to cancel the reservation in reimbursing VN Consulting the total amount paid by the CUSTOMER.

The CUSTOMER has the right to unilaterally cancel the reservation with a refund of the total amount paid as follows:

·         Refund of 100% of the total amount paid if the cancellation occurs more than 60 days before the registration date.

·         Refund of 50% of the total amount paid if the cancellation occurs between 59 and 30 days before the date of entry.

 

If the CUSTOMER cancels his reservation unilaterally less than 30 days before the date of entry, he will not receive any refund and will not be able to claim or ask for the refund of the sums already paid.

In the event that VN Consulting makes changes to the ACCOMODATION and / or PRICES published after the confirmation of the reservation and up to 8 days before the CUSTOMER arrives at the ACCOMMODATION, which affects essential points of the contract, the CUSTOMER may resolve unilaterally the contract, without charge, within 7 days of said communication, being refunded the payment made.

A cancellation is considered made when VN Consulting has received the cancellation in writing.

4. DEPOSIT REFUND POLICY

Only the amounts corresponding to the damages caused by the CUSTOMER or the other persons staying with him in the ACCOMMODATION can be deducted from the amount of the deposit.This damage will be quantified according to the criteria of VN Consulting, accepting the validity of this criterion the CUSTOMER.

In case of finding dirty dishes or garbage without taking out, the amount stipulated in the rules of each establishment will be deducted from the deposit.

Once the corresponding amounts have been deducted from the deposit, the CUSTOMER will receive the refund of the remaining amount or will pay the difference in case the deposit does not cover all the damage caused.

 

5. ACCOMODATION CONDITIONS

5.1. Minimum stay

The minimum stay for the period from 27/06/2019 to 04/09/2019 (both included) is 7 nights. For all other dates, the minimum stay is 3 nights.

5.2. Days of entry and exit

The days of entry and exit in high season (from 13/07/2020 to 24/08/2020) are exclusively on Saturdays.

5.3. Time of entry and exit

The arrival time will be between 16h and 20h and the departure time before 11h in the morning.

If the CUSTOMER cannot adapt to this schedule, he must contact VN Consulting to set another day and time for key collection. VN Consulting does not guarantee the delivery of keys on the day of arrival if this schedule is not respected and the CUSTOMER will bear the additional costs that may occur due to non-compliance with the schedule, without the right to claim for this reason.

If the CUSTOMER cannot occupy his ACCOMODATION on the day of his arrival or when collecting the keys for any difficulty during the trip or for personal reasons, as well as if he shortens his stay, VN Consulting will not make any refund. If the CUSTOMER wishes to extend his stay in the ACCOMMODATION, he must check the availability with VN Consulting.

5.4. Additional services

The prices for each ACCOMMODATION include bed linen and towels.

For stays of more than 3 weeks, a set of sheets and towels is included per extra person at no extra charge.

The amount of final cleaning is indicated in each ACCOMMODATION and is not included in the price.

Additional services such as baby cot, baby chair or additional cleaning are not included in the price of the ACCOMMODATION and can be rented by the CUSTOMER at the time of booking. It is recommended that you sign up for these services as soon as possible so that VN Consulting can guarantee their availability.

5.5. Information provided

The information provided on each ACCOMMODATION (facilities, bedding, etc.) and the general information on the services of each locality (means of transport, businesses, restaurants, sports centers, etc.) are periodically updated. VN Consulting is not responsible for any variations that may occur after its preparation, nor for its perfect correspondence with reality at any time.

6. CUSTOMER OBLIGATIONS

6.1 Occupation

The occupation of the ACCOMODATION will be limited to the number of persons indicated in the contract, counting children and babies as persons for the purpose of occupation. The PROPERTY or the staff of VN Consulting will be able to prevent entry into the accommodation if the authorized number is exceeded.

In the event that VN Consulting or its representatives confirm the overcrowding of the ACCOMMODATION, VN Consulting and the PROPERTY reserve the right to terminate the rental agreement with immediate effect and without notice. In this case, VN Consulting will not be obliged to refund the rent paid by the CUSTOMER.

6.2 Deposit

Upon arrival at the ACCOMMODATION, the CUSTOMER will pay a deposit to the staff of VN Consulting. The deposit varies according to each ACCOMMODATION, the amount is indicated on the card and will be indicated in the email of confirmation of the reservation. 

If this deposit is not paid, the staff of VN Consulting reserves the right to forbid the CUSTOMER to occupy the ACCOMMODATION and could result in the termination of the contract with loss of the amounts delivered.

In general, VN Consulting does not accept groups of young people whose average age is 25 years or less. VN Consulting may, at its discretion, double the amount of the deposit for rents paid to persons under 25 years of age or groups of youth over 6 persons.

6.3. State of accomodation

The CUSTOMER has the obligation to leave the ACCOMODATION in a collected and presentable state. This includes (for illustrative and not limiting) the fact that the dishes must be clean and in place and that the garbage must have been emptied. This will also be valid if the CUSTOMER has initiated a final cleaning, or the cleaning is included in the rental price.

If the CUSTOMER does not leave the accommodation in the state mentioned above, VN Consulting reserves the right to cover additional cleaning costs using the amount of the deposit.

6.4. Respect for neighbors

VN Consulting is committed to family and responsible tourism and supports the various campaigns promoted by municipalities in this regard. The CUSTOMER must respect the neighbors and the rules of the community of owners to which the ACCOMODATION belongs. In case of negligence or improper behavior, VN Consulting and PROPRIETY reserve the right to terminate the rental agreement with immediate effect and without notice. In this case, VN Consulting will not be obliged to return the amounts delivered by the CUSTOMER.

6.5. Responsibility

The CUSTOMER agrees to be responsible for the use made of the ACCOMMODATION by him and by the persons who lodge with him, and any damages that could result during his stay.

7. CLAIMS

Although VN Consulting strictly controls its dwellings before each CUSTOMER change, it is possible that the ACCOMODATION has a defect. In this case, the CUSTOMER must communicate it immediately and at the latest 48 hours after arrival to the staff of VN Consulting. If the problem can not be resolved in this way, after allowing a reasonable period of time to correct the defect, the CUSTOMER must inform VN Consulting directly at (+34) 670566422 or by email at booking@vnconsulting.es. The request must include the name and surname of the person who assisted you during your stay. VN Consulting will not be responsible for a subsequent complaint when the CUSTOMER has not made any complaint during the occupation of the ACCOMMODATION or during his stay.

8. LIABILITY

8.1. Limitation of liability

In the event that the booked accommodation contains serious defects preventing its normal use, VN Consulting will propose a relocation solution with characteristics and prices as close as possible to those initially proposed to the CUSTOMER.

If reACCOMODATION is not possible, either due to lack of available accommodation or because the CUSTOMER has rejected all proposed reACCOMODATION proposals, the proportional part of the amount will be refunded (depending on when the ACCOMODATION was taken) without no other liability can be attributed to VN Consulting.

Notwithstanding the provisions of the applicable regulations, the responsibility of VN Consulting is limited to its intermediation function, in accordance with its field of intervention and is effectively developed by VN Consulting and does not assume any of the responsibilities which, in accordance with the law, correspond to PROPERTY in the rental of ACCOMODATION. In any case, the CUSTOMER agrees that the financial responsibility of VN Consulting for damages that may be caused by its intermediation is limited to the total amount paid for the lease.

8.2. Exclusion of liability

VN Consulting assumes no responsibility in the following cases:

  1. Neglect of the CUSTOMER or one of the guests staying with him at the ACCOMMODATION.
  2. Neglect or omission of services attributable to third parties (by orientation, but not limited to): distribution companies (electricity, water, gas, telecommunications), maintenance companies (swimming pool, gardening), etc.
  3. Malfunctions or malfunction of swimming pools, children's playgrounds and sports facilities of any kind, which leaves the use strictly under the responsibility of the CUSTOMER.
  4. Theft or loss of objects in the ACCOMODATION.
  5. Bodily or material damage caused by force majeure or unforeseen setbacks that VN Consulting or its representatives can not meet.

8.3. Credit card information

VN Consulting declares that it does not have access to sensitive data concerning the means of payment used by the CUSTOMER nor store them. Only the corresponding entity processing the payment has access to this data as payment and collection management, this entity being completely foreign to VN Consulting, VN Consulting can not answer for the use it makes of it.

9. VALIDITY AND COMPETENT JURISDICTION

When booking accommodation, the general conditions indicated above will apply, which will govern the rental agreement for seasonal accommodation that will be signed at the time of your arrival. VN Consulting acts as an intermediary between the CUSTOMER and the ACCOMODATION PROPERTY and is responsible for the smooth running of the mediation, which is carried out in accordance with the legislation in force. The present general conditions as well as the indicated prices are considered valid, except typographical error, from 01/01/2020 to 31/12/2020 and replace the previous published conditions.

The present general conditions and the contract between the CUSTOMER and the PROPERTY will be governed, interpreted and executed according to the Spanish law before the courts of Blanes (Girona), in Spain.
